Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Proposaic application ("the App"), available as a mobile application on Android and iOS and as a web application, operated by POCKET IMPLEMENTATION S.R.L. ("us", "we", "our", "the Company").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App on any platform.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.

1. DEFINITIONS

• "App" refers to the Proposaic application, including the mobile applications for Android and iOS and the web application (built with Kotlin/Wasm technology), and any future platforms on which the App may be made available.
• "Service" refers to the services provided through the App, including proposal and cover letter generation, professional profile management, CV/resume profile extraction, job description extraction, and all related features and functionality.
• "User", "You", and "Your" refer to the individual accessing or using the App.
• "Content" refers to information such as text, documents, files, images, or other material that may be generated, submitted, uploaded, or otherwise accessed through the App.
• "AI-Generated Content" refers to any proposals, cover letters, profile extractions, or other text generated by artificial intelligence through the App, including but not limited to content produced by third-party AI services such as OpenAI and DeepSeek.
• "Proposaic PRO" refers to the premium subscription service offered within the App, including monthly, yearly, promotional, and trial subscription tiers.
• "File Uploads" refers to CV/resume documents and other files you upload to the App for processing and profile extraction.
• "Share Extension" refers to the iOS share extension feature that allows you to pass URLs and content from other applications to the App for job description extraction.

2. DESCRIPTION OF SERVICE

Proposaic is an AI-powered application available on Android, iOS, and the web, designed to help freelancers and job seekers create personalized proposals and cover letters. The App allows users to:

• Create professional profiles manually or by uploading CV/resume files (PDF, DOC, DOCX) for AI-powered extraction
• Input job descriptions manually, via URL extraction (web scraping), or through the iOS Share Extension
• Generate tailored proposals and cover letters using artificial intelligence technology provided by third-party AI services (OpenAI and DeepSeek)
• Manage, refine, and iterate on generated documents
• Provide feedback on generated content to improve service quality

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, specific outcomes, or the accuracy of any AI-generated output.

3. ACCEPTANCE OF TERMS

By creating an account, downloading, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, regardless of whether you are a registered user of our App and regardless of the platform on which you access the App.

4. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the App and must cease using the Service.

5. ACCOUNT REGISTRATION AND SECURITY

5.1 Account Creation

To use certain features of the App, you must register for an account. When you register, you will be required to provide certain information and establish a username and password. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5.2 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5.3 Third-Party Authentication

We offer Google Sign-In and Apple Sign-In as authentication methods. By using these features, you agree to comply with the respective third-party's terms of service in addition to these Terms. We receive limited profile information (name, email, authentication tokens) from these authentication providers as described in our Privacy Policy.

5.4 Encrypted Storage

Authentication tokens and session data are stored in encrypted local storage on your device. You are responsible for the physical security of your device and for preventing unauthorized access to it.

6. SUBSCRIPTION PLANS

6.1 Free Plan

The App offers limited functionality free of charge, which includes generating up to 3 documents (proposals or cover letters) per month.

6.2 Proposaic PRO

Proposaic PRO is a paid subscription that unlocks all features and allows for unlimited document generation and refining. Proposaic PRO is available in monthly and yearly subscription tiers. Subscription fees will be clearly displayed before you complete the purchase.

6.3 Free Trials and Promotional Plans

We may, at our sole discretion, offer free trial periods or promotional subscription plans ("Promotional Plans"). Free trials and Promotional Plans are subject to the following:

• Eligibility for free trials is determined by the platform (Apple App Store, Google Play Store, or RevenueCat) and may vary. We do not control trial eligibility decisions.
• At the end of any free trial period, your subscription will automatically convert to a paid subscription at the then-current subscription price unless you cancel before the trial ends.
• Promotional Plans may offer reduced pricing or extended trial periods and are subject to additional terms disclosed at the time of the offer.
• We reserve the right to modify, suspend, or terminate any free trial or Promotional Plan at any time without prior notice.
• Free trials and Promotional Plans are non-transferable and may only be used once per user account.

6.4 Billing

All purchases and subscriptions are processed through third-party platforms: Apple App Store (for iOS users), Google Play Store (for Android users), or RevenueCat (for web users). The App never collects, processes, or stores your payment card information, billing address, or other financial data. All payment processing is handled entirely by these third-party platforms, and you are subject to their respective terms and conditions.

All purchases and subscriptions are final and non-refundable, except as required by applicable law or the policies of the respective app store or payment platform.

6.5 Subscription Cancellation

You may cancel your Proposaic PRO subscription at any time through the respective platform's subscription management settings (Apple App Store, Google Play Store, or your web account).

Please note that deleting your Proposaic account will not automatically cancel your subscription. You must manage your subscription directly through the platform where you purchased it. Upon cancellation, your subscription will remain active until the end of the current billing period, and you will not receive a refund for any unused portion of your subscription.

7. USER CONTENT

7.1 User Input

You understand that when using the App, you will be prompted to provide certain information about your professional career, skills, and job descriptions. You are solely responsible for the content you provide, and you represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all relevant information to enable your use of the App.
• Your content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or other personal or proprietary rights.

7.2 Ownership of Generated Content

All proposals, cover letters, and other documents generated through the App based on your input belong to you. We claim no ownership rights over these generated documents.

7.3 File Uploads and CV/Resume Processing

You may upload CV/resume files (PDF, DOC, DOCX) to the App for automated profile extraction. By uploading files, you acknowledge and agree that:

• Uploaded files are transmitted to our servers and processed by third-party AI services (OpenAI or DeepSeek) to extract professional profile information.
• You are solely responsible for ensuring that uploaded files do not contain sensitive personal data beyond what is necessary for professional profile creation (e.g., do not include government-issued ID numbers, medical information, or financial account details).
• We do not permanently store uploaded files. Files are processed in memory and discarded after extraction is complete. The extracted profile data is stored as part of your account.
• We make no guarantees regarding the accuracy or completeness of the extraction. AI-based extraction may produce errors, omissions, or misinterpretations of your document content.
• You retain all rights to the content of your uploaded files. We claim no ownership rights over your uploaded documents.

7.4 Share Extension (iOS)

The iOS Share Extension allows you to share URLs from other applications (such as Safari or other browsers) to the App for job description extraction. By using the Share Extension:

• The shared URL is stored locally in a shared app group container on your device and passed to the App.
• The URL may be sent to our servers for web scraping to extract job description content. This scraping may involve third-party services (Crawlbase or browser-based extraction) as described in Section 9.
• You are responsible for ensuring you have the right to access and share the URL content.
• We do not guarantee successful extraction from all URLs. Some websites use protections that prevent automated content extraction.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 App Content

The App and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of POCKET IMPLEMENTATION S.R.L. and its licensors. The App is protected by copyright, trademark, and other laws of both Romania and foreign countries.

8.2 Restrictions

You may not:

• Copy, modify, reproduce, or create derivative works of the App or any content belonging to POCKET IMPLEMENTATION S.R.L.
• Use any of our trademarks, including "Proposaic," without our prior written consent.
• Reverse engineer, decompile, or disassemble the App.
• Remove, circumvent, disable, damage, or otherwise interfere with security-related features of the App.
• Use the App in any manner that could disable, overburden, damage, or impair the App or interfere with any other party's use of the App.

9. THIRD-PARTY SERVICES AND CONTENT

9.1 Third-Party Services

The App integrates with, relies upon, or contains links to the following third-party services. These third-party services have separate and independent privacy policies and terms of service. We have no responsibility or liability for the content, practices, or activities of these services:

• Google — Authentication (Google Sign-In), Firebase Analytics, Firebase Crashlytics
• Apple — Authentication (Apple Sign-In), App Store subscription processing, SKAdNetwork (SKAN) attribution
• OpenAI — AI-powered content generation (proposals, cover letters, profile extraction)
• DeepSeek — AI-powered content generation (fallback/alternative provider)
• RevenueCat — Subscription management, billing, and purchase verification across all platforms
• Kochava — Mobile attribution, install tracking, and SKAdNetwork (SKAN) conversion event reporting
• Crawlbase — Server-side web scraping for job posting URL extraction
• MongoDB — Cloud database for data storage
• SMTP Email Service — Transactional email delivery (email verification, password reset, account notifications)

You acknowledge that your use of the App may involve the transfer of your data to these third-party services as described in our Privacy Policy.

9.2 AI Integration and Output Limitations

The App uses artificial intelligence models from third-party providers such as OpenAI and DeepSeek to generate content. IMPORTANT DISCLAIMERS:

• AI-generated content may not always be accurate and may contain material inaccuracies even if it appears accurate due to its level of detail or specificity.
• You should not rely on AI-generated proposals, cover letters, or any output as a sole source of truth or factual information, or as a substitute for professional advice.
• You must evaluate all AI-generated content for accuracy and appropriateness for your specific use case, including using human review, before using or sharing any output from the App.
• You must not use any AI-generated content relating to a person for any purpose that could have a legal or material impact on that person, such as making credit, educational, employment, housing, insurance, legal, medical, or other important decisions about them.
• AI-generated content may be incomplete, incorrect, or contain biases that do not represent our views or the views of our AI providers.
• We do not guarantee that AI-generated proposals or cover letters will result in successful job applications, client acquisitions, or any specific outcomes.

You acknowledge that artificial intelligence and machine learning are rapidly evolving fields, and that the probabilistic nature of machine learning may result in outputs that do not accurately reflect real people, places, facts, or circumstances.

9.3 Web Scraping and Job Description Extraction

When you provide a job posting URL (either directly in the App or through the iOS Share Extension), we may use automated web scraping tools to extract the job description content. You acknowledge that:

• Web scraping is performed server-side using Crawlbase (for specific job platforms) and/or browser-based automation.
• We do not control the accuracy or completeness of scraped content. The extracted text may be incomplete, incorrectly formatted, or missing information.
• Some websites may block automated extraction. We do not guarantee successful extraction from any URL.
• You are responsible for verifying the extracted content before using it for document generation.

10. APP TRACKING TRANSPARENCY AND DEVICE TRACKING

10.1 iOS App Tracking Transparency (ATT)

On iOS devices, the App may request your permission to track your activity across other companies' apps and websites through Apple's App Tracking Transparency framework. This permission affects whether:

• IDFA (Identifier for Advertisers) is made available to our attribution partners (Kochava, RevenueCat).
• Attribution data linking your app install to specific marketing campaigns can be collected.

If you grant tracking permission: We and our partners (Kochava, RevenueCat) may collect your IDFA to attribute your install and in-app purchases to marketing campaigns and optimize our advertising.

If you deny tracking permission: The App will continue to function normally. We will not access your IDFA. Attribution will rely on privacy-preserving mechanisms such as Apple's SKAdNetwork (SKAN). RevenueCat will still collect your IDFV (Identifier for Vendor).

You can change your tracking preference at any time in your iOS device Settings under Privacy & Security > Tracking.

10.2 Android Advertising ID

On Android devices, we may collect your Google Advertising ID for attribution and analytics purposes. You can reset or opt out of personalized advertising through your device's Settings.

10.3 SKAdNetwork (SKAN)

On iOS, we use Apple's SKAdNetwork for privacy-preserving install attribution. SKAN provides aggregated, non-personally-identifiable attribution data to advertising networks without revealing your identity. Kochava processes SKAN conversion events (such as Subscribe, StartTrial, and RegistrationComplete events) on our behalf.

11. PROHIBITED USES

You agree not to use the App:

• In any way that violates any applicable national, federal, state, local, or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App, or which, as determined by us, may harm the Company or users of the App, or expose them to liability.
• To use the App to generate content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or racially, ethnically, or otherwise objectionable.
• To generate proposals or cover letters that contain false, misleading, or fraudulent information.
• To systematically scrape, crawl, or extract data from the App or its API endpoints.
• To attempt to circumvent subscription or generation limits through automated means.

11.1 USER RESPONSIBILITY FOR AI-GENERATED CONTENT

YOU ACKNOWLEDGE AND AGREE THAT:

• ANY USE OF AI-GENERATED OUTPUTS IS AT YOUR SOLE RISK
• YOU ARE SOLELY RESPONSIBLE for reviewing, verifying, and determining the appropriateness of all AI-generated content before use
• YOU WILL NOT REPRESENT that AI-generated content was human-created when it was not
• YOU UNDERSTAND that AI systems may produce content that appears plausible but is factually incorrect, biased, or inappropriate
• YOU WILL COMPLY with all applicable laws and regulations when using AI-generated content, including but not limited to employment laws, anti-discrimination laws, and professional licensing requirements

12. SERVICE AVAILABILITY AND INTERRUPTIONS

12.1 No Guarantee of Availability

WE DO NOT GUARANTEE THAT THE APP OR ANY PART OF THE SERVICE WILL BE AVAILABLE AT ALL TIMES OR AT ANY PARTICULAR TIME. The App may be subject to interruptions, delays, failures, or other limitations due to:

• Scheduled or unscheduled maintenance
• Software updates or upgrades
• Third-party service outages (including but not limited to AI providers, cloud hosting, authentication services, payment processors, and attribution services)
• Network or infrastructure failures
• Security incidents or remediation
• Regulatory or legal requirements

12.2 Modifications and Discontinuation

We reserve the right to modify, suspend, or discontinue the App or any feature thereof, temporarily or permanently, at any time and for any reason, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App or the Service.

12.3 Beta and Experimental Features

From time to time, we may offer features that are designated as "beta," "experimental," "preview," or similar designations. Such features are provided on an "as is" and "as available" basis without any warranty of any kind. BETA AND EXPERIMENTAL FEATURES MAY BE UNSTABLE, CONTAIN ERRORS, OR BE DISCONTINUED AT ANY TIME WITHOUT NOTICE. YOUR USE OF BETA AND EXPERIMENTAL FEATURES IS AT YOUR SOLE RISK, AND YOU SHOULD NOT RELY ON THEM FOR ANY CRITICAL PURPOSE.

13. DISCLAIMER OF WARRANTIES

13.1 "As Is" and "As Available"

THE APP AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POCKET IMPLEMENTATION S.R.L. AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
• WARRANTIES OF ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WARRANTIES THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR ANY PURPOSE
• WARRANTIES THAT FILE UPLOADS WILL BE PROCESSED ACCURATELY OR COMPLETELY
• WARRANTIES THAT WEB SCRAPING OR URL EXTRACTION WILL SUCCEED OR PRODUCE ACCURATE RESULTS
• WARRANTIES THAT THE APP WILL BE AVAILABLE ON ALL PLATFORMS AT ALL TIMES
• WARRANTIES REGARDING THE PERFORMANCE, RELIABILITY, OR AVAILABILITY OF ANY THIRD-PARTY SERVICE INTEGRATED WITH THE APP
• WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE

13.2 Specific AI-Related Disclaimers

WE SPECIFICALLY DISCLAIM ANY WARRANTIES REGARDING:

• The accuracy, quality, or appropriateness of AI-generated proposals, cover letters, or other content
• The suitability of AI-generated content for any particular job application or client proposal
• The likelihood of success when using AI-generated content
• The absence of errors, biases, or inappropriate material in AI-generated content
• The accuracy or completeness of professional profile data extracted from uploaded CV/resume files
• The accuracy of content extracted from job posting URLs via web scraping
• Any outcomes resulting from job applications or client proposals created using the App
• The continued availability or performance of any AI model or third-party service

AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO PROPOSALS, COVER LETTERS, AND PROFILE EXTRACTIONS, IS PROVIDED WITH ABSOLUTELY ZERO WARRANTY OF ANY KIND. THE OUTPUT IS GENERATED BY THIRD-PARTY AI SYSTEMS OVER WHICH WE HAVE NO CONTROL AND FOR WHICH WE ASSUME NO RESPONSIBILITY.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP AND ANY AI-GENERATED CONTENT IS AT YOUR SOLE RISK. YOU ASSUME ALL RESPONSIBILITY FOR ANY CONSEQUENCES ARISING FROM YOUR USE OF AI-GENERATED CONTENT.

WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT USE OF THE APP WILL RESULT IN SUCCESSFUL JOB APPLICATIONS, CLIENT ACQUISITIONS, OR ANY SPECIFIC PROFESSIONAL OUTCOMES. THE APP IS A TOOL TO ASSIST YOU, AND OUTCOMES DEPEND ON NUMEROUS FACTORS BEYOND OUR CONTROL.

14. LIMITATION OF LIABILITY

14.1 Exclusion of Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POCKET IMPLEMENTATION S.R.L., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS, LICENSORS, OR DISTRIBUTORS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP
• DAMAGES ARISING FROM ANY AI-GENERATED CONTENT, INCLUDING PROPOSALS OR COVER LETTERS
• DAMAGES ARISING FROM FAILED JOB APPLICATIONS OR CLIENT PROPOSALS
• DAMAGES ARISING FROM RELIANCE ON AI-GENERATED CONTENT
• DAMAGES ARISING FROM ANY THIRD-PARTY CONDUCT OR CONTENT
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• DAMAGES ARISING FROM FILE UPLOAD PROCESSING ERRORS OR INACCURACIES
• DAMAGES ARISING FROM WEB SCRAPING FAILURES OR INACCURACIES
• DAMAGES ARISING FROM SERVICE INTERRUPTIONS OR UNAVAILABILITY
• DAMAGES ARISING FROM THIRD-PARTY SERVICE OUTAGES OR FAILURES

THIS EXCLUSION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP OR THESE TERMS EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID TO US FOR THE APP IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR
• FIFTY EUROS (€50)

14.3 Essential Terms

THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION ARE ESSENTIAL ELEMENTS OF THE AGREEMENT BETWEEN YOU AND US. THE APP WOULD NOT BE PROVIDED TO YOU WITHOUT THESE LIMITATIONS.

15. INDEMNIFICATION

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS POCKET IMPLEMENTATION S.R.L., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, AND EXPENSES (INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEYS' FEES AND COSTS) ARISING FROM:

• Your use or misuse of the App or Services
• Your violation of these Terms or any applicable law or regulation
• Your use of AI-generated content, including any proposals or cover letters
• Any false, misleading, or fraudulent information in AI-generated content you use
• Any employment-related disputes arising from your use of AI-generated content
• Your violation of any third party's intellectual property, privacy, or other rights
• Any content you submit to or generate through the App
• Your failure to comply with professional licensing or other legal requirements
• Files you upload to the App, including any claims related to the content of such files
• URLs you share or provide for web scraping and job description extraction

THIS INDEMNIFICATION OBLIGATION WILL SURVIVE TERMINATION OF THESE TERMS AND YOUR USE OF THE APP.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

16.2 Binding Arbitration

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL BE RESOLVED BY BINDING ARBITRATION administered in accordance with the arbitration rules of the Bucharest Court of International Commercial Arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

The arbitrator may award the same damages and relief as a court, but the arbitrator's decision and award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

16.3 Exception to Arbitration

Notwithstanding Section 16.2, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

16.4 EU Consumer Protection

If you are a consumer within the European Union, you may benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these terms, including the above governing law and arbitration provisions, affects your rights as a consumer to rely on such mandatory provisions of local law. EU consumers retain the right to bring proceedings in their local courts as required by applicable EU consumer protection law.

17. FORCE MAJEURE

POCKET IMPLEMENTATION S.R.L. SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMING ITS OBLIGATIONS UNDER THESE TERMS WHERE SUCH FAILURE OR DELAY RESULTS FROM CIRCUMSTANCES BEYOND ITS REASONABLE CONTROL, including but not limited to:

• Acts of God, natural disasters, epidemics, or pandemics
• War, terrorism, civil unrest, or government actions
• Power outages, internet or telecommunications failures
• Third-party service provider outages or failures (including AI providers, cloud hosting, payment processors, attribution services, and app stores)
• Cyberattacks, DDoS attacks, or other security incidents
• Changes in applicable law or regulation
• Labor disputes or strikes

During any period of force majeure, our obligations under these Terms shall be suspended, and the time for performance shall be extended by the duration of the force majeure event.

18. TERMINATION

18.1 Termination by You

You may terminate your account and discontinue use of the App at any time by following the instructions in the App or by contacting us.

18.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

18.3 Effect of Termination

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

19. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

20. ENTIRE AGREEMENT

The Terms constitute the entire agreement between you and POCKET IMPLEMENTATION S.R.L. regarding our App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning our App.

21. PROFESSIONAL AND LEGAL COMPLIANCE

21.1 Professional Responsibility

YOU ACKNOWLEDGE THAT:

• You are solely responsible for ensuring that any use of the App and AI-generated content complies with applicable professional standards, licensing requirements, and ethical obligations
• You must not use the App to create content that violates professional codes of conduct
• You are responsible for fact-checking and verifying all AI-generated content before submission to potential employers or clients

21.2 Legal Compliance

YOU REPRESENT AND WARRANT THAT:

• Your use of the App will comply with all applicable employment laws, anti-discrimination laws, and other legal requirements
• You will not use AI-generated content in any manner that could constitute fraud, misrepresentation, or deception
• You understand that submitting false or misleading information to employers or clients may have legal consequences for which you are solely responsible
